1. General Provisions

These Terms & Conditions (hereinafter: "Terms") regulate the relationship between Nolxide d.o.o. (hereinafter: "Nolxide", "platform") and users who access or use the nolxide.com website and related real estate crowdfunding services.

By accessing and using the platform, you confirm that you have read, understood, and accepted these Terms in their entirety. If you disagree with any part of these Terms, please do not use the platform.

2. Definitions

"Platform" refers to the nolxide.com website and all related digital services. "User" is any natural or legal person who accesses or uses the platform. "Investor" is a registered user who participates in crowdfunding projects. "Project" refers to a real estate crowdfunding project published on the platform. "Project Organizer" is the entity that initiates and manages a particular crowdfunding project.

3. Use of the Platform

The platform is intended for adults residing in the Republic of Croatia or other European Union member states. By using the platform, you warrant that you are at least 18 years old and have the legal capacity to enter into contracts.

Users are obliged to provide accurate and current data during registration and use of the platform. Nolxide reserves the right to suspend or close a user account in case of providing false information or violating these Terms.

4. Registration and User Account

Participation in crowdfunding projects requires registration on the platform. The registration process includes providing personal data, identity verification in accordance with legal requirements, and accepting these Terms of Use.

Users are responsible for maintaining the confidentiality of their access credentials. Any activity performed through the user account is deemed the activity of the account holder.

5. Crowdfunding Investments

Investments through the platform are subject to the specific conditions of each project, which are detailed on the project page. Nolxide acts as an intermediary between investors and project organizers and does not guarantee return on investment or profit realization.

Each project on the platform undergoes internal review before publication, but Nolxide cannot guarantee successful project completion. Investors are obliged to independently assess the risks associated with each investment.

6. Investment Risks

Real estate crowdfunding investment carries inherent risks, including the possibility of partial or total loss of invested capital, delays in project implementation, changes in market conditions, and regulatory changes that may affect investment returns.

Nolxide recommends that investors only invest funds they can afford to lose and that they diversify their investments. Past project results do not guarantee future results.

7. Fees and Costs

Nolxide may charge fees for brokerage services, project management, and transaction processing. All applicable fees are clearly stated before finalizing any investment. Nolxide reserves the right to modify fees with prior notice to users.

8. Intellectual Property

All content on the platform, including texts, graphics, logos, images, software, and design, is the property of Nolxide d.o.o. or its licensors and is protected by the intellectual property laws of the Republic of Croatia and international conventions.

Users are granted a limited, non-exclusive license for personal use of the platform. Any copying, distribution, modification, or commercial use of content without the express written permission of Nolxide is strictly prohibited.

9. Limitation of Liability

Nolxide provides the platform "as is" and makes no warranties, express or implied, regarding the availability, accuracy, or reliability of the platform. To the fullest extent permitted by law, Nolxide shall not be liable for any direct, indirect, incidental, or consequential damages arising from the use of the platform.

This limitation does not affect consumer rights guaranteed by the mandatory regulations of the Republic of Croatia or the European Union.

10. Termination and Account Closure

Users may close their account at any time by contacting Nolxide customer support. Account closure does not affect existing investments, which will continue according to the terms of each project.

Nolxide reserves the right to suspend or permanently close a user account in case of violation of these Terms, suspected fraudulent activity, or at the request of competent authorities.

11. Applicable Law and Dispute Resolution

These Terms are governed by the laws of the Republic of Croatia. For all disputes arising from the use of the platform, the competent court in Zagreb, Republic of Croatia, shall have jurisdiction.

Before initiating court proceedings, the parties undertake to attempt to resolve the dispute amicably within 30 days from the date of written notice of the dispute.
